Lot LOT-0001 — Reconstruction and expansion of the ice rink hall along with the construction of parking lots, a pylon, flagpoles, landscaping, and accompanying infrastructure - Stage I as part of the task "Reconstruction and expansion of the Ice Rink Hall at 4 Chemików St. in Oświęcim"

1. The subject of the order is the execution of construction works consisting of the reconstruction and expansion of the Ice Rink Hall along with the construction of parking lots, a pylon, flagpoles, landscaping, and accompanying infrastructure - Stage I as part of the task "Reconstruction and expansion of the Ice Rink Hall at 4 Chemików St. in Oświęcim", also referred to in the procurement documents as the "investment task" or "investment."
2. The subject of the order includes the construction of the building designated in the procurement documents, including the design documentation, as "SEGMENT A."
3. The subject of the order, for the execution of which the contractor selected in this procedure will be obligated, is the implementation of the investment task in accordance with the requirements and conditions specified by the Ordering Party, through the performance of construction works, along with the delivery of necessary materials, devices, and equipment, and the implementation of all accompanying activities within the investment.
4. The Ordering Party anticipates co-financing of the investment from the Physical Culture and Sports Development Fund under the "Program of Investments of Special Importance for Sports for 2025." The funds intended for financing the order are divided into eligible and non-eligible costs. The amount of co-financing from the Physical Culture Development Fund will not exceed 50% of the eligible costs. Details of the rules for co-financing the strategic investment program from the Physical Culture Fund are available on the website of the Ministry of Sport and Tourism: www.msport.gov.pl. The contractor is obliged to familiarize themselves with the program and the rules for granting co-financing.
5. A detailed description and scope of the subject of the order (subject to the reservation mentioned in point 6) along with the Ordering Party's requirements, conditions for the execution of the order, acceptance and settlement, warranty and statutory liability conditions have been specified in the procurement documents attached to the Terms of Reference (SWZ), including among others: a) design documentation, b) approvals, c) bills of quantities, d) contract template for this public order, e) warranty document template.
6. The quantitative scopes of works indicated in the SWZ and its attachments (in the bills of quantities) are estimated values and may change. The indicated quantities do not constitute an obligation on the part of the Ordering Party to order services in the quantities specified in these documents.
7. Documents published by the Ordering Party in connection with this proceeding, including the documents referred to in point 6, constitute a whole and are the basis for calculating the offer price by the contractors.
8. The Ordering Party provides for the possibility of canceling the procedure if the public funds it intended to allocate for financing the whole or part of the order have not been granted.
